Content refers to text, images, audio files, video and other media published within EnglishScore, including test questions.

An English as a second language program composed of various learning Content.
Data Controller
Means the person that controls what happens to your personal data that is stored or otherwise processed on EnglishScore. We are the data controller for the purposes of the Data Protection Legislation.
EnglishScore
EnglishScore means our products and services, including those that we have licensed from others and provide as a branded experience. Our products and services are provided in different ways:
- As one or more websites (our main website is https://bcesdev.wpengine.com/);
- As an app that is downloaded or streamed from an App Store or our websites to your device; and/or
- Embedded within a third party’s websites or systems.
Sometimes when we say “EnglishScoreâ€, we mean the actual score you receive by completing a Test.

Intellectual property rights
Means copyright, rights related to copyright such as moral rights and performers rights, patents, rights in inventions, rights in confidential information, know-how, trade secrets, trade marks, geographical indications, service marks, trade names, design rights, rights in get-up, database rights, databases, data exclusivity rights, approvals, utility models, domain names, business names, rights in computer software, mask works, topography rights, the right to sue for infringement, unfair competition and passing off, and all similar rights of whatever nature wherever in the world arising and, in each case (a) whether registered or not, (b) including any applications to protect or register such rights, (c) including all renewal and extensions of such rights or applications, (d) whether vested, contingent or future, and (e) wherever existing.

Personal data
Means data which can identify you as a person – this can be any of the following:

| Device Data | the type of mobile device you use, a unique device identifier, mobile network information, your mobile operating system, the type of mobile browser you use, time zone setting |
| Profile Data | your username and password, in-App purchase history, your interests, preferences, feedback and survey responses |
| Usage Data | details of your use of any of our App including, but not limited to, traffic data and other communication data, whether this is required for our own billing purposes or otherwise |
| Marketing and Communications Data | your preferences in receiving marketing from us and our third parties and your communication preferences |
| Location Data | your location supplied when entering billing information or by using GeoIP technology |
| Educational Data | answers you supply to EnglishScore via a Test, your results from the Test, and the grade(s) or similar you achieve when completing further learning or assessment services offered by Us or Our Partners |
Services
Means the services provided by EnglishScore to Users which enable Users to take a language proficiency test, receive their test scores, purchase and receive a Certificate, receive product recommendations (either for other products provided by Us or third parties), and related services.
Test
Means any and all of the EnglishScore tests and/or assessments which may be undertaken by a licensed user of the App to rate and score their English language proficiency.
Tutor
A person who provides tutoring services to you.
User, Student
A registered user of the App.
User Generated Content
Content that is supplied by users of EnglishScore.
Unkind or horrible material
Words or actions that are disruptive, offensive, abusive, unlawful, harassing, defamatory, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable in any respect.
